1. Acceptance of Terms

These Terms & Conditions ("Terms") govern access to and use of Shishyams, a multi-tenant institute management platform operated by Gurushishya Multiskills Pvt. Ltd. ("Shishyams", "we", "us"). By registering an organization, institute, or user account, or by otherwise accessing the platform, you agree to be bound by these Terms.

2. Description of Service

Shishyams provides a software-as-a-service platform for educational institutes, including modules for academics, attendance, exams, fees and accounting, HR, communication, and a public website builder for each institute. Features available to an account depend on the subscription plan selected.

3. Account Registration & Eligibility

• You must provide accurate and complete information when registering an organization or institute account.
• An organization admin may create multiple institutes under one organization; each institute operates with its own data and staff logins.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Public self-registration accounts are provisioned under a shared demo organization until upgraded to a paid, dedicated organization.

4. Institute & Admin Responsibilities

Institutes are responsible for the accuracy and lawfulness of the student, parent, and staff data they enter into the platform, and for obtaining any consents (including parental consent for minors) required under applicable law before doing so. Institute admins are responsible for managing staff access levels appropriately within the platform's role-based permission system.

5. Subscription, Fees & Payments

• Paid plans are billed as described at checkout or in your organization's subscription settings; features, limits, and pricing may vary by plan.
• Fee payments collected by an institute from its students via the platform's integrated UPI/payment gateway are the institute's own receivables; Shishyams facilitates the transaction but is not a party to the underlying fee arrangement between institute and student.
• Subscription fees, once paid, are non-refundable except where required by law or expressly stated at the time of purchase.
• An institute or organization may be suspended for non-payment; suspension blocks logins and shows a maintenance notice on the institute's public website, while data is retained intact.

6. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of applicable education, data protection, or consumer protection laws.
• Attempt to gain unauthorized access to another institute's or user's data or account.
• Upload content that is defamatory, obscene, infringing, or otherwise harmful.
• Interfere with or disrupt the platform's infrastructure, security, or availability.
• Misuse communication features (push notifications, WhatsApp/chatbot, contact forms) to send unsolicited or unlawful messages.

7. Data Ownership

As between an institute and Shishyams, the institute retains ownership of the student, parent, staff, and academic data it enters into the platform. Shishyams stores and processes this data solely to provide the service, as described in our Privacy Policy. Upon account termination, an institute may request export or deletion of its data, subject to any legal retention requirements.

8. Intellectual Property

The Shishyams platform, including its software, design, and branding, is the property of Gurushishya Multiskills Pvt. Ltd. and is protected by applicable intellectual property laws. These Terms do not grant you any right to use Shishyams branding, trademarks, or platform code outside of your authorized use of the service.

9. Third-Party Integrations

Shishyams may allow institutes to connect optional third-party services (for example, Google Drive for gallery storage, WhatsApp for chat, or payment gateways). Use of these integrations is subject to the respective third party's own terms and privacy policy, and Shishyams is not responsible for their availability or conduct.

10. Service Availability

We aim to keep the platform available and reliable but do not guarantee uninterrupted, error-free operation. Scheduled maintenance, third-party outages, or unforeseen technical issues may result in temporary downtime. Automated backups are taken as a precaution but are not a substitute for an institute maintaining its own records where critical.

11. Limitation of Liability

To the maximum extent permitted by law, Shishyams and Gurushishya Multiskills Pvt. Ltd. shall not be liable for indirect, incidental, or consequential damages arising from use of the platform, including loss of data, revenue, or business opportunity, except where such liability cannot be excluded under applicable law.

12. Termination

You may stop using the platform and request account closure at any time. We may suspend or terminate an account that violates these Terms, engages in unlawful activity, or has an unresolved payment issue, after reasonable notice where practicable.

13. Changes to These Terms

We may revise these Terms from time to time to reflect changes to the platform or legal requirements. The "Last updated" date above reflects the most recent revision. Continued use of Shishyams after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the platform shall be subject to the exclusive jurisdiction of the courts having authority over Gurushishya Multiskills Pvt. Ltd.'s registered place of business.
